Reasonable Expectation of Privacy

It is an affirmative defense to prosecution under this section that:

  1. the possession, creation, production, recording, broadcast, transmission, posting, disclosure or promotion consists of a visual depiction of the voluntary exposure of the depicted person's nudity or sexually explicit conduct in a public setting; or
  2. the identifiable individual depicted did not have a reasonable expectation that the image would remain private.
