Elements
An offense is committed if a person intentionally or knowingly engages in sexual penetration or sexual contact with another who:
- is not aware of the essential characteristics of the act due to the perpetrator's fraud or deceit; or
- is not aware of the essential characteristics of the act due to the perpetrator's fraudulent representation that the sexual penetration or contact served a medical or professional purpose when it did not; or
- is acting under the belief that the perpetrator is someone known to them that is not the accused, and this belief is intentionally induced by the artifice, pretense, or concealment of the accused.
