Abusive Sexual Exposure

Elements

An offense is committed by:

  1. intentionally, knowingly, or recklessly showing or exposing one's own anus, breast, buttock, penis, scrotum, vulva, vagina, for the purpose of sexual abuse, sexual harassment, sexual arousal, sexual gratification, sexual humiliation, or degradation of any person; or
  2. intentionally, knowingly, or recklessly exposing the anus, breast, buttock, penis, scrotum, vulva, vagina, for the purpose of sexual abuse, sexual harassment, sexual arousal, sexual gratification, sexual humiliation, or degradation of another person without that person's consent. 

Grading

An offense committed under section (a) is a _ degree misdemeanor. An offense committed under section (b) is a _ degree misdemeanor unless forcible compulsion is used to facilitate the offense, then it is a _ degree felony.
