“A person acts knowingly with respect to a material element of an offense when:

  1. if the element involves the nature of [that person’s] conduct or the attendant circumstances, [that person] is aware that the conduct is of that nature or that such circumstances exist; and
  2. if the element involves a result of [that person’s] conduct, [that person] is aware that it is practically certain that [the] conduct will cause such a result.”
  1. The term and definition of “knowingly” is identical to The Model Penal Code § 2.02(2)(b), however, the term “his” was removed and/or replaced with “that person” to make this provision gender neutral. ↩
