Abusive Sexual Conduct Involving Ejaculate, Vaginal Fluid, or other Bodily Fluid or Substance

Elements

An offense is committed by:

  1. intentionally, knowingly, or recklessly causing contact of another with ejaculate or vaginal fluid without their consent; or
  2. intentionally, knowingly, or recklessly causing contact of another with saliva, blood, urine, or feces without their consent for the purpose of sexual arousal, sexual humiliation, sexual gratification, or sexual degradation.

Grading

An offense committed under this section is a _ degree misdemeanor unless forcible compulsion is used to facilitate the offense, then it is a _ degree felony.
