Sexual Torture

Elements

An offense is committed if a person intentionally, knowingly, or recklessly:

  1. burns, crushes, wounds, or mutilates the genitalia, genital area, anus, buttocks, or breasts of another; or
  2. fully exposes or exposes with less than fully opaque covering, the genitalia, genital area, buttocks, or breast of another, prior to causing the exposed person bodily injury, serious bodily injury, or death; or
  3. dresses a person in a particular outfit for the purposes of sexual gratification prior to causing the person bodily injury, serious bodily injury, or death.

Sexual torture does not include procedures performed by a licensed medical professional in accordance with a valid medical purpose.

Grading

An offense under this section is a first-degree felony.
