Sexual Assault

Elements

An offense is committed by:

  1. intentionally, knowingly, or recklessly causing sexual penetration without consent; or 
  2. intentionally, knowingly, or recklessly causing sexual contact without consent.

Grading

An offense under this section is a second-degree felony except that an offense under this section is a _ degree felony when any of the following aggravating factors exist:

  1. that person gains unlawful entry into or remains unlawfully in a building, dwelling, or vehicle to facilitate commission of the sexual assault;
  2. that person commits sexual assault with one or more additional perpetrators;
  3. that person commits sexual assault in the presence or awareness of others during the commission of the sexual assault; 
  4. that person commits sexual assault and records or livestreams during the commission of the sexual assault.
