Abusive Sexual Conduct

Elements

An offense is committed by intentionally, knowingly, or recklessly causing contact of the breast and/or buttock of another without that person’s consent for the purpose of sexual abuse, sexual harassment, sexual arousal, sexual gratification sexual humiliation, or sexual degradation. 

Grading

An offense committed under this section is a _ degree misdemeanor unless forcible compulsion is used to facilitate the offense, then it is a _ degree felony.
